These Terms and Conditions govern the 776BC Performance Pack Competition (Competition). Information on how to enter and prize details published on the official entry page for the relevant regatta event (Event) form part of these Terms and Conditions. Participation in this Competition constitutes acceptance of these Terms and Conditions. Any entry not complying with these Terms and Conditions is invalid.

2.1 Entry is open to residents of Australia.
2.2 Entrants under the age of 18 years must have the consent of a parent or legal guardian to enter the Competition.
2.3 By entering the Competition, entrants under 18 years of age warrant that they have obtained the consent of a parent or legal guardian.
2.4 The Promoter reserves the right to request written evidence of parental or guardian consent at any time and may disqualify an entrant if such consent cannot be verified.
2.5 Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this Competition are ineligible to enter.
2.6 Immediate family means: spouse, ex-spouse, de-facto spouse, child or step-child (natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
3.1 To enter, eligible individuals must complete and submit the official Entry Form available via the 776BC Competition entry page for the relevant Event.
3.2 Submission of a completed Entry Form constitutes one (1) entry (Entry).
3.3 Limit of one (1) Entry per person unless otherwise specified on the official Competition entry page.
3.4 Entries must be received during the Competition Period. The Promoter is not responsible for any entries not received for any reason during the Competition Period, including technical malfunction, network failure or platform issues.
4.1 The Competition commences and closes at the times specified on the official 776BC Competition entry page for the relevant Event (Competition Period).
4.2 The Promoter reserves the right to extend or amend the Competition Period, subject to applicable regulatory requirements.
5.1 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including identity, age and place of residence).
5.2 The Promoter may disqualify any entrant who:
Submits an entry not in accordance with these Terms and Conditions;
Tampers with the entry process; or
Engages in fraudulent, misleading or deceptive conduct.
5.3 Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any right does not constitute a waiver of that right.
5.4 Incomplete, indecipherable or illegible entries will be deemed invalid.
6.1 Entrants acknowledge and agree that their Entry must not be:
Obscene, defamatory, libellous, threatening, harassing or hateful;
Racially or ethnically offensive;
Encouraging conduct that would constitute a criminal offence or give rise to civil liability; or
In breach of any applicable law.
6.2 Each entrant warrants that they have the legal capacity to enter the Competition. Where an entrant is under 18 years of age, a parent or legal guardian is deemed to have accepted these Terms and Conditions on the entrant’s behalf.
6.3 To the extent permitted by law, entrants (and where applicable, their parent or legal guardian) agree to indemnify the Promoter against loss arising from a breach of these Terms and Conditions.
7.1 One (1) winner will be selected.
7.2 At the conclusion of the Competition Period, one (1) valid Entry will be drawn at random.
7.3 This Competition is a game of chance. Skill plays no part in determining the winner.
7.4 The draw will take place within fourteen (14) days of the end of the Competition Period.
7.5 The draw will be conducted electronically using a random selection process at the Promoter’s business premises in Victoria, Australia.
7.6 The winner (Winner) will be notified privately via email from info@776bc.com within seven (7) days of the draw.
7.7 The Winner’s details will not be published publicly unless required by law.
8.1 The Winner will receive one (1) 776BC Performance Pack consisting of:
One (1) unisuit
One (1) base layer
One (1) pair of socks
Total maximum prize pool value: RRP AUD $248 (inclusive of GST).
8.2 The Prize will be supplied within forty-five (45) days of the draw.
8.3 The Prize must be taken as stated and:
Is not transferable (unless agreed by the Promoter);
Is not exchangeable for other goods or services;
Cannot be redeemed for cash;
Must be used for personal use only and must not be resold or auctioned without prior written consent of the Promoter.
8.4 If the Prize becomes unavailable for any reason, the Promoter reserves the right to substitute it with a prize of equal or greater value, subject to regulatory requirements.
9.1 If the Winner is not contactable or does not claim the Prize within thirty (30) days of notification, the Prize will be forfeited.
9.2 The Promoter reserves the right to redraw and award the Prize to an alternate winner, subject to any directions from a relevant regulatory authority.
10.1 If the Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to circumstances beyond the Promoter’s reasonable control, the Promoter reserves the right, to the fullest extent permitted by law, to:
Disqualify any entrant; or
Modify, suspend, terminate or cancel the Competition, subject to regulatory approval if required.
10.2 Any cost associated with accessing the entry form is the entrant’s responsibility and dependent on their internet service provider.
10.3 The use of automated entry software or other mechanical or electronic means that allows repeated automatic entries is prohibited and will render entries invalid.
10.4 Except for liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for:
Personal injury;
Loss or damage (including loss of opportunity);
Direct, indirect, special or consequential loss;
arising in any way out of the Competition or the use of the Prize.
10.5 The Promoter is not liable for delay or failure to perform its obligations where such delay or failure results from events beyond its reasonable control, including but not limited to acts of God, war, fire, earthquake, strike, sickness, accident or civil commotion.
11.1 Personal information provided by entrants will be used for the purpose of administering the Competition and conducting the Promoter’s business activities, including:
Notifying the Winner;
Delivering the Prize;
Market research; and
Providing information about products and services (unless the entrant or their parent/guardian opts out).
11.2 Where an entrant is under 18 years of age, personal information may be provided by a parent or legal guardian on their behalf.
11.3 The Promoter may contact a parent or legal guardian to verify consent or confirm prize acceptance where the Winner is under 18.
11.4 Communications may be made via email, telephone or other electronic means.
11.5 If requested information is not provided, the entrant may not be eligible to enter the Competition.

11.7 This Competition is not sponsored, endorsed, administered by or associated with Instagram or TikTok. Any personal information provided via those platforms is subject to their respective privacy policies.
These Terms and Conditions are governed by the laws of Victoria, Australia.
